New Kids Sue Ex-Director Over Charges of Fakery

New Kids on the Block have filed a defamation suit against their former music director, who has publicly charged that the group was involved in musical fakery.

Leonard L. Lewin, the New Kids' lawyer, said the group filed a civil suit against Gregory McPherson on Monday in Massachusetts Superior Court in Boston. The lawsuit contends that statements Mr. McPherson made about the group to The New York Post were false and defamatory and were made to injure the New Kids for Mr. McPherson's private gain. It asks the court for an unspecified amount in punitive damages.

Last month The New York Post, The New York Times and other news organizations reported assertions by Mr. McPherson, who also produced the New Kids' records for two years, that the group contributed no more than 20 percent of the singing on any of their albums. Mr. McPherson contends that the group's founder, Maurice Starr, and his brother, Michael Johnson, did the rest. He also maintains that New Kids did none of the singing in a Coca-Cola commercial in which they appeared in 1990 and that they went on tour with an eight-track tape to supplement their singing.

In a telephone interview yesterday, Mr. McPherson called the suit against him "a joke" and was "an attempt made to cover the truth."

"This slander suit is one way they are trying to bog me down in litigation to try to jade the issues even further," he said.

But Mr. Lewin said in a telephone interview from Boston that Mr. McPherson's allegations had caused the New Kids "a lot of embarrassment, ridicule within the industry and anguish, not only among the group but fans who follow the group." He said he believed that Mr. McPherson made his allegations in an attempt to bolster his own position in a lawsuit he has filed against Mr. Starr. Breach-of-Contract Suit

Mr. McPherson made his allegations against the New Kids as he filed a suit against Mr. Starr, charging breach of contract and creative infringement. In the suit, he says that he was not paid for producing sound tracks for the group's video "Hanging Tough Live" and television commercials for it, and that the group's managers had not given him formal credit for his creative contributions. He said he did not include his allegations of fakery in the lawsuit because he had helped them to carry it out. Mr. Starr has denied all the allegations.

"It hurts," Mr. Lewin said of Mr. McPherson's allegations, "because what he says isn't true."

The five members of the New Kids, founded in 1984, performed live on "The Arsenio Hall Show" last week in a bid to disprove allegations that they received help with their singing.
